On September 10, at around 3:49 a.m., a Byram police officer reported seeing a vehicle parked on the shoulder of Route 206. When the officer checked on the vehicle, he observed the driver, Nicholas J. Kost, 36, of North Arlington, sleeping in the driver’s seat.
The officer woke Kost up, at which time the officers suspected that Kost may be intoxicated. Kost was asked to perform several field sobriety tests, which he reportedly failed. Kost was then arrested and transported to the station where he consented to and failed two breath tests.
Kost was charged with the following and released to a friend pending a mandatory Andover-Joint Municipal Court date: driving while intoxicated, careless driving, reckless driving, unregistered motor vehicle, failure to inspect, no insurance and failure to provide an insurance card.
