March 2 A 16-year-old Newton juvenile pled guilty on Feb. 9 to one count of second degree Burglary; one count third degree Burglary, two counts of Theft by Unlawful Taking, a third degree crime, and two counts of third degree Criminal Mischief. He was adjudicated a juvenile delinquent by the court and sentenced to three years in the custody of the Juvenile Justice Commission. The juvenile must submit to DNA sample at own expense, cooperate and testify truthfully against co-defendants, have no contact with co-defendants or victims and pay restitution in an amount of $3,355 along with $195 in court fines. The juvenile, along with four other adult co-defendants, broke into two different homes, taking various items including guns and jewelry and caused damage to both homes. March 3 James Smith, 26, of Franklin was sentenced to two years probation with the condition he serve 364 days in the county jail. Smith was convicted of fourth degree Criminal Trespass after a trial before the Hon. Thomas Critchley on Dec. 6, 2005. On Jan. 10, he entered a guilty plea to a third degree Burglary. The convictions stemmed from his illegal entry into two residences in Franklin. In one of the homes, Smith stole property with the help of two other individuals. March 6 David Hoek, 26, of Lafayette pled guilty to two counts of distribution of heroin within 500 feet of a park, a crime of the second degree, and to possession of heroin, a crime of the third degree. He is scheduled for sentencing on April 21. He admitted that on June 8, 2005, he distributed four bags of heroin, and on June 10, 2005, he distributed 22 bags of heroin to an individual cooperating with the Sussex County Narcotics Task Force. The distributions occurred in his apartment that was located within 500 feet of the Lafayette Municipal Park. He also admitted to possessing heroin on June 28, 2005 when a search warrant was executed at his residence by members of the Sussex County Narcotics Task Force and New Jersey State Police. Nicholas Florentine, 33, Vernon entered a guilty plea to an accusation charging him with the fourth degree charge of possession of child pornography. Florentine admitted to the court that on or about March 22, 2005, he had knowingly possessed in excess of 100 images of children engaged in prohibited sexual acts or in simulation of such acts and that he did so by storing those images on his computer. Fiorentino is scheduled to be sentenced on April 21. Bradford Mayne, 27, of Sparta pled guilty to absconding from parole, a crime of the third degree. He is scheduled for sentencing on April 21, He admitted leaving the State of New Jersey in order to avoid supervision by the Intensive Supervision Program after he had been paroled from state prison. He was taken into custody in Florida. Steven Savare, 32, of Budd Lake pled guilty to distribution of MDMA (Ecstasy), a crime of the third degree. He is scheduled for sentencing on April 21. He sold eight Ecstasy pills on Aug. 5, 2005 in Ray’s Inn in Andover Township to an individual cooperating with the Sussex County Narcotics Task Force.
