    May 1 Billie Webb, 26, of Montague, pleaded guilty to third-degree possession of heroin and/or cocaine. She admitted that she constructively possessed 32 vials of cocaine and four bags of heroin following a motor vehicle stop by Sparta Police Officer John Lamon on July 27, 2005. Webb is scheduled to be sentenced on June 9. Jason Guadagno, 26, of Lafayette, was sentenced to three years probation, 270 days in county jail, substance abuse treatment, $1,205 in fines and a six month loss of driver’s license. Guadagno pleaded guilty on April 10 to third-degree possession of heroin. He admitted to possessing two bags of heroin after the Newton police responded to a report of his overdose. May 2 Robert Ackerly, 26, of Matamoras, Pa., was sentenced to three years in state prison, $1,205 in fines and a six month loss of driver’s license. Ackerly plead guilty on Feb. 27 to third-degree posession of heroin. He admitted to constructively possisessing 48 bags of heroin following a motor vehicle stop by Sparta Police Officer Marc Rubino on Dec. 28, 2005. May 8 Charles Collins, 24 of Basking Ridge, was sentenced to five years incarceration in state prison, with the requirement pursuant to the provisions of the No Early Release Act, that he must serve 85 percent of his prison sentence before being eligible for parole. Collins was given 379 days credit. He must also pay $1221.82 restitution to the victims of his offenses and $1,130 in penalties and assessments. He will also lose his driving privileges for one year. Collins pleaded guilty on March 9 to two counts of second-degree aggravated assault, two counts of third-degree aggravated assault, and to unlawful possession of a weapon, and theft of a motor vehicle, both third-degree offenses. He admitted that on June 28, 2004, during an altercation, he stabbed a victim in the chest area with a knife and attempted to stab a second victim. He also admitted that on June 24, 2004, he removed a motorcycle that did not belong to him from the flat bed of a truck. May 9 Brianne H. Lutz, 23, of Newton, pleaded guilty to third-degree burglary. On Aug. 28, 2005, she entered a doctor’s office and took a bag containing several items of baby necessities. She indicated to police that she did not enter the building and take the bag, it was a male friend of hers. Sentencing is anticipated for June 23. May 10 Brian Gardner, 22, of Newton, entered a guilty plea to an accusation charging him with one count of a fourth-degree charge for a Megan’s Law violation for failure to notify law enforcement that he had moved to a new address. Under the provisions of Megan’s Law, Gardner was required to notify the local police that he was moving to a new address 10 days prior to his actual move. Gardner admitted to the court that between Oct. 18 through Dec. 6, 2005, he had moved to a new address in Newton without notifying the Newton Police Dept. that he had moved. The case was investigated by DSG Michael Richards of the Newton police. Sentencing is scheduled for June 23.
