    On Saturday morning March 10, 2007 at 6:15 a.m. Newton Police Officers responded to a 911 call from a resident on Merriam Avenue who reported that there was an intruder in her house. The victim stated that she was asleep in bed on the second floor of her single family home and awakened to see an unknown male subject standing near her bed looking at her. Her screaming awakened her husband who immediately got out of bed and confronted the subject. He chased him down the stairs and physically pushed him out of his house. During his flight from the home, the subject caused damage inside the home and caused injury to himself as evidenced by blood left at the scene. The homeowners provided police with a description of the suspect. Patrol Officers then searched the area for the subject and shortly afterward responded to a sighting of a subject fitting the description in the area of Carriage Lane. At 6:50 a.m., Officers located the suspect in a driveway on Main Street. He was bleeding from his head and his physical description and clothing were a match. He was taken into custody and identified as Luis Javier, a 21 year old male who resides at 99 Water Street Newton. Further investigation revealed that the suspect forced his way into the residence after causing damage to a rear door. He left shoe impressions in the snow outside the victim’s residence that were a match to the shoes that he was wearing when he was arrested. The defendant was charged with criminal trespass and criminal mischief. He was incarcerated in the Sussex County Jail in default of $15,000.00 no 10 percent option. The victim homeowners were not injured during the incident and the couple were the only occupants of the home. The intent of the defendant remains under investigation.
